Police Reconstruction report shows Michael Bryant as aggressor


Documents raise troubling questions regarding prosecutor’s decision to drop charges against former Attorney General.

Darcy Allan Sheppard’s father has released the police collision reconstruction report, officers’ memo books, summary records of 911 calls and other documents that point to questions about freelance prosecutor, Richard Peck’s explanation of his decision that relate to his son’s death.The police reconstruction report contains statements from nineteen eyewitnesses, none of whom mention Michael Bryant’s car stalling. Witnesses clearly paint Bryant as the aggressor, confirming what the surveillance video has already shown.

According to media reports of the court proceedings Michael Bryant received the police reconstruction report on or about March 5, 2010. According to Bryant’s book Mark Sandler interviewed him on March 23, 2010. It should be noted that the reconstruction report makes no mention of the possibility that Bryant’s car could have stalled. It seems this claim may have first been made on March 23, 2010.

From the conclusions of the police report:

Mr. BRYANT struck Mr. SHEPPARD not once, but twice from a stopped position on Bloor Street West east of the pedestrian signalized intersection which was captured on a building security cameras at#102 Bloor Street West.

There was no physical evidence, or independent witness statements suggesting Mr.SHEPPARD affected the steering of the Saab, or anything to suggest he physically attacked Mr. BRYANT.

Prosecutor Peck dismissed statements from eyewitnesses who were within a few feet from the attack such as this:

Witness Statement 9.13:

Out for a walk with husband on Bloor Street at the Pottery Barn.

Saw a cyclist in front of a car standing.

Cyclist stated “You want me to move now.”

The car driver bumped him I yelled “stop it”.

The bike was under the car, the cyclist got up.

The car driver tried to run him over, I told my husband to call 91 1 and now get the plate. I screamed it hoping he would cool it.

The cyclist threw his knapsack onto the car.

The cyclist ran after the car and hung onto the car with both arms over the driver’s side of the car.

The car was going top speed and the cyclist was holding on for dear life, he couldn’t let go.

The car sped onto the wrong side of the road.

The bike was in the middle of the road.

I saw people down the road, I didn’t see what happened.

The car was going fast, 90 Km/h he sped off at top speed with the cyclist’s feet dragging on the ground.

The cyclist was definitely tormenting the car.

The car bumped him, tried to drive off and the cyclist hit the bonnet of the car he couldn’t let go.

I picked up the bike and the knapsack and someone else helped me with the knapsack as the back wheel was not working on the bicycle.

Not like the guy was going to attack the driver, it was like the cyclist didn’t want the driver to leave.

Mr. Allan Sheppard will meet members of the media on 23 May 2013 to give a short statement and raise serious questions and concerns about the handling of the case by Special Prosecutor Peck and his Toronto agent, Mark Sandler.

Anyone that has had any dealing with the criminal justice system in Canada has known since the beginning of this (what, investagation, trial?) that it was fixed from the beginning,(just name me one person arrested and put into the cells ,waiting for bail hearing that got a new suit to put on and had a shave and shower before court). Most are lucky to get toilet paper, They should have just let him go from 51 division and had him come back to court to have the charges withdrawn. There is no justice in this country and you have no rights or freedoms, just ask anyone that never had a police record but was put in a third world cage at the G8 G20 summit.

    Mr. Bryant was not completely telling the truth when he stated “whenever a politician is accused of a criminal offense the whole system bends over backward to protect the rights of the public it is specifically designed to do so”. No it is designed to have counsels lie, politicians cover up supported by police that report to them, and have politically linked press craft misleading articles and have judges give political and not judicial decisions – as they are appointed by the political system – all to protect and not hold accountable politicians. It is time that judges were all audited and that they were appointed and reviewed by boards designed to have 64% diverse members of the public to ensure that their democratic rights were primary. J
